Tastemakers, LLC (“Arcade1Up”) Sweepstakes (“Sweepstakes”)

No purchase necessary to enter or win. Making a purchase will not increase your chances of winning. Void where prohibited by law.

The A1UP Companion App Giveaway (the “Giveaway”) runs on March 14, 2023, to April 4, 2023. The sponsor of the Giveaway is Arcade1Up (the “Sponsor” or “Arcade1Up”). By entering the Giveaway, you (“Entrant” or “you”) accept and agree to follow Official Rules.

Who May Enter: The Giveaway is open only to legal residents of (i) the 50 United States, District of Columbia, and Canada who are age 18 years or older at the time of entry. By submitting an entry, you represent and warrant that you meet the eligibility requirements set forth in these Official Rules and agree to be bound by these Official Rules and any other requirements designated by Sponsor. The Giveaway is governed by United States law and is subject to all applicable federal, state, and local laws and regulations.

How to Enter:

Download the A1Up companion app between March 14^th and April 4^th for a chance to win one (1) A1Up Deluxe Cabinet.
In addition, 50 people will receive a $25 discount code at arcade1up.com
If more than 25,000 people download the app, Sponsor will give away four (4) A1Up Deluxe Cabinets.
and 100 people will receive a $25 discount code at arcade1up.com

Sponsor will not be responsible for lost, late, incomplete, stolen, illegible, or misdirected entries due to any reason.

Random Drawing: There will be a total of 1 Winner. Winner will be randomly selected by a computer process from eligible entries received. Random drawings will be conducted at or about April 4, 2023.

Claiming Prize:  All properly claimed prizes will be awarded. As a condition of winning the prizes, the winners must complete, sign, and return an affidavit of eligibility and liability and publicity release, where permitted by law, and any other applicable forms required by a taxing authority within ten (10) days of receipt of written prize notification or prizes will be forfeited and an alternate winner selected. Further, by accepting the prize, the winner consents to Sponsor’s use of their name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes including advertising and promotional activities without additional compensation, unless prohibited by law.

If any correspondence of the sweepstakes judge or any prize is returned as undeliverable, the corresponding prize will be forfeited and will be awarded to an alternate winner. Should a winner make any false statement(s) in any document referenced above, the winner will be required to promptly return to Sponsor his/her prize. Any unclaimed prizes will be awarded in a random drawing to be held as necessary. In the event there is a dispute of the entrant’s identity, the prize will be awarded to the established email account associated with the entry.

Prize Information; Approximate Retail Value and Odds of Winning:

Total Approximate retail value in the United States (“ARV”) $499.

Based upon the estimated number of entries to be received, the odds of winning are <1% of the number of entries we receive. The actual odds of winning will depend upon the actual number of entries received for this sweepstakes.

Liability Release: To the fullest extent permitted by law, by participating in the Giveaway, Entrant agrees to forever and irrevocably release, discharge, indemnify, and hold Sponsor, Sponsor’s licensors, and each of their respective directors, officers, employees, parent companies, subsidiaries, affiliates, divisions, agencies and all prize suppliers, harmless from any and all liability, losses, damages, rights, claims, and actions of any kind in connection with the Giveaway, or resulting from acceptance, possession, use or misuse of any prize, including any activity related thereto, including without limitation to the fullest extent permitted by law personal injuries, death and property damage, and claims based on publicity rights, defamation, or invasion of privacy, whether suffered by Entrant or a third party. By entering the Giveaway, each Entrant agrees to abide by and accept as final the Sponsor’s decisions and waives any right to appeal.

Publicity Release: To the fullest extent permitted by law, by participating in the Giveaway, Entrant grants Sponsor permission to use, except where prohibited by law, Winner’s name, Instagram, Twitter, or Facebook username, image, likeness, and state of residence, for Sponsor’s advertising and promotional purposes in all forms of media, now or hereafter known, throughout the world and on the Internet in perpetuity, without compensation or additional consents from Entrant and prior notice, approval or inspection.

Miscellaneous Conditions: The sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries. The sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by sponsor on account of technical problems, human error or traffic congestion on the internet or at any website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this giveaway or downloading any materials in this giveaway. If for any reason this giveaway is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this giveaway, the sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and/or to cancel, terminate, modify or suspend the giveaway.

Privacy: Sponsor will be collecting, processing, and using personal information provided by Entrants in accordance with Sponsor’s privacy policy. Please review Sponsor’s privacy policy at https://arcade1up.com/pages/privacy-policy. By participating in the Giveaway, you agree to Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s privacy policy.

Governing Law: By entering the Giveaway, Entrant acknowledges and agrees that these Official Rules, the Giveaway, and all disputes related thereto are governed by the laws of the State of Florida in United States, without regard to its conflict of laws principles.

Right to Cancel Giveaway: Sponsor reserves the right at its sole discretion to cancel, terminate, modify, or suspend the Giveaway.
